Professor Chin Publishes Op-ed on Supreme Court Double Jeopardy Case

Professor Gabriel “Jack” Chin published an op-ed in the Daily Journal on Bravo-Fernandez v. United States, in which the U.S. Supreme will review what Chin describes as “a tricky question of double jeopardy law which has divided the lower courts: how to treat convictions that were vacated and are no longer in effect.”

The case involves a former Puerto Rico state senator's claim that he cannot be retried on corruption charges involving a trip to Las Vegas to watch a boxing match after his original conviction was thrown out. Chin is signed onto an amicus brief arguing that double jeopardy precludes a retrial. In his essay, Chin provides a summary of relevant Supreme Court precedent and reiterates the argument against a retrial. 

Gabriel "Jack" Chin is Martin Luther King, Jr. Professor of Law and holder of the Edward L. Barrett Endowed Chair at UC Davis School of Law. He is a prolific and much-cited criminal and immigration law scholar whose work has addressed many of the most pressing social issues of our time.
