Dean Johnson Comments on U.S. v. Texas for Federalist Society Podcast

Dean Kevin R. Johnson was interviewed for a podcast produced by the Federalist Society regarding U.S. v. Texas, the Supreme Court case in which Texas and other states are challenging the Obama administration's deferred action on immigration programs. 

Appearing with Professor John C. Eastman of Chapman University School of Law, Dean Johnson recounted the history of deferred action in immigration enforcement, and explained in detail the issues before the Supreme Court, which include questions of standing and administrative law as well the issue of whether the deferred action programs violate constitutional requirements that the president "take care that the laws be faithfully executed."

"It is important to know that if a very strict interpretation of the Take Care clause were to be adopted by the Court, it could have impacts on the exercise of all kinds of prosecutorial discretion decisions, from IRS decisions to criminal law decisions to enforcing the provisions of the Environmental Protection Act, so I'm sure that people will be carefully watching where the Court goes with this if it takes it up," Dean Johnson said.

Kevin R. Johnson is Dean and Mabie-Apallas Professor of Public Interest Law and Chicana/o studies at UC Davis School of Law. He is an internationally recognized scholar in the fields of immigration law and policy, refugee law, and civil rights.
