Professor Bhagwat Publishes Commentary in New York Times

Professor Ashutosh Bhagwat has published an entry in "Room for Debate," a feature of the New York Times website. The essay appears as one of a group of articles on the topic of "Troubling Trademarks" and whether the government may decline to register trademarks it considers to be disparaging, such as that of the Washington Redskins football team. Professor Bhagwat states his firm belief that banning the registration of disparaging trademarks is unconstitutional.

"Controversial though this is, I believe that it is justified both by the exceptionally uninhibited, robust and sometimes nasty nature of American democracy, and by concerns that the power to suppress hate speech will be abused by government officials," writes Bhagwat.

Ashutosh Bhagwat, Martin Luther King, Jr. Professor of Law at UC Davis School of Law, is an innovative, broad-ranging, and widely published constitutional law scholar.
