U.S. Supreme Court Allows “Remain in Mexico” Policy to Stay in Place

On March 11, 2020, in the case of Wolf v. Innovation Law Lab, the U.S. Supreme Court handed down an order that the Trump administration may continue enforcing its “Remain in Mexico” policy while a lawsuit challenging it goes through the courts. The policy, officially named the “Migrant Protection Protocols”, was first implemented in January 2019 and requires asylum seekers in the U.S. to wait in Mexico for their U.S. immigration court hearings. The 9th U.S. Circuit Court of Appeals previously ruled that the policy was probably illegal. See ABA Journal, CNN, SCOTUSblog.
