California Supreme Court Overturns Court Order Protecting Elephants

The California Supreme Court rejected the use of a taxpayer suit as a vehicle for enforcing animal cruelty laws. In Leider v. Lewis, the justices ruled that a court cannot issue a mandatory injunction to enforce a criminal statute absent specific legal authority. The court overturned trial court orders mandating that the Los Angeles Zoo take specified measures to improve the conditions of its elephants.
