Supreme Court Drops ATM Fee Cases

The U.S. Supreme Court dropped two antitrust cases involving ATM fees because the parties switched arguments after certiorari was granted. The closely watched antitrust cases involved the country’s two biggest credit card companies and the fees they charged for using ATM machines. In its order , the court wrote, “After having persuaded us to grant certiorari on this issue, however, petitioners chose to rely on a different argument in their merit briefing…The Court, therefore, orders that the writs in these cases be dismissed as improvidently granted”.
