Judge Issues Tentative Ruling in Online Escort Case

Sacramento Superior Court Judge Michael Bowman issued a tentative ruling  in favor of the operators of a major international online escort service, who are charged with pimping and conspiracy.  Judge Bowman wrote, “Congress struck a balance in favor of free speech in that Congress did not wish to hold liable online publishers for the action of publishing third party speech and thus provided for both a foreclosure from prosecution and an affirmative defense at trial.  Congress has spoken on this matter and it is for Congress, not this Court to revisit”.  The judge gave both sides more time to submit briefs before issuing a final ruling next month.  Read articles in Courthouse News Service and the Sacramento Bee.
